ABLOOMY Technologies, Inc., a California corporation (“we”, “us”, “our”) takes your privacy seriously. We have developed this Privacy Policy (“Privacy Policy”) to explain what we collect from our users (“users” or “you”) through https://www.kidbalance.net (the “Site”) and/or our software applications, including those for use on mobile devices, tablets, personal computers, and any other devices, such as KidBalance and KidBalance Kids (collectively, the “Software”), and how we use and share this information. The Site and the Software are collectively referred to herein as the “Services”. We may change this Privacy Policy from time to time and will notify you by revising the date at the top of the Privacy Policy. Please review this Privacy Policy whenever you access the Services to stay informed of our information and privacy practices.
By using the Services, you consent to the collection, use, and sharing of your and your children’s information by Abloomy in accordance with this Privacy Policy.
1. Information We Collect
a. In order to use the Services, you must register an account. During registration, you will be asked to provide certain personal information, including your phone number or email address, and for the diagnostic purpose, we may collect some information of your device on which KidBalance is installed, such as the type of device, device unique ID, the IP address, the operating system, (collectively, the “Parent Information”). Except for the Parent Information, KidBalance does not collect any information or log data from your device.
b. With your consent, Abloomy may collect your Children’s personal information (the “Children Information”) in connection to your use of the Services through KidBalance Kids. Children Information may include information you voluntarily submit to us such as your child’s first, middle and last name, date of birth, age, gender, and profile photo, or it may include information we collect from your child as a result of your use of the Services, such as your child’s device access times (e.g., we may collect information relating to how long your child uses or accesses his or her device), device identifier numbers, serial numbers, geolocation information, and other internet, device, or electronic network activity information, including, but not limited to, encrypted screenshots generated by your KidBalance account and the transcribed content from the screenshots (e.g., through optical character recognition), as authorized by you (“Screenshots’). Screenshots may capture your children’s browsing activity, search activity, messaging activity, and other information regarding your child’s interaction with an internet website, application, advertisement, device, or interactions with a device in general. In order to provide the Services, we may also collect information from your child’s device about your child’s usage and activity in connection with the Services (e.g., error/crash reporting, usage analytics such as screen views, your child’s use of any hyperlinks available within the Services, time on page, and page hits). For the diagnostic purpose, we may collect some information of your child’s device on which KidBalance Kids is installed, such as the type of device, device unique ID, the IP address, the operating system,
c. The Parent Information and the Children Information are collectively referred to herein as the “Information”.
d. In regard to the European Union, our collection of personal information from a child is limited and controlled by the parent.
2. How We Collect the Information
Our products collect the Information in a variety of ways, including when you interact with us electronically or in person, when we provide our services to you, when you use the Services.
3. Use of the Information
Our products use the collected data for various purposes:
a. To provide and maintain our products /services;
b. To notify you about changes to our products /service;
c. To provide customer support;
d. To gather analysis or valuable information so that we can improve our products /service;
e. To monitor the usage of our products / service;
f. To detect, prevent and address technical issues;
g. To provide you with notices about your account and/or subscription, including expiration and renewal notices, email-instructions, etc.;
h. In any other way we may describe when you provide the information;
i. For any other purpose with your consent.
4. Disclosure of the Information
We may share information with third parties who provide services to us, such as payment processing, analytics, website management, information technology, and other similar service providers.
We may disclose your information as we believe to be necessary or appropriate to: (1) comply with applicable law and legal processes; (2) respond to requests from public and government authorities, including public and government authorities outside your country of residence; (3) enforce our legal agreements; (4) protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and (5) allow us to pursue available remedies or limit the damages that we may sustain.
We reserve the right to share your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets.
We may use your data to create aggregate or statistical information that does not directly identify a specific person, and we may share that information. For example, we may share anonymous and aggregated reports and information on user demographics and traffic patterns with third parties.
5. The Security of the Information
We are committed to ensuring that the Information is secure. In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorized access, modification and disclosure.
The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorized disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Policy.
6. Children’s Privacy Rights
We do not sell products or services to children. The Services are not intended for children to submit Personal Information to us without the consent of their legal guardians. In compliance with the Children’s Online Privacy Protection Act (“COPPA”), How we use and disclose the information from children is detailed above in Section 3 and 4.
We will not collect more information from your children than is reasonably necessary to provide the Services.
In accordance with COPPA, you may upon request, review the Children’s information we have collected from your child, and direct us to delete such information, and/or refuse us to allow any further collection or use of your children’s information.
For European Union data subjects, our collection of personal data from a child is limited and controlled by the parent.
7. California Reidents’ Privacy Rights
We do not sell, disclose, trade, or rent the Information to third parties to market their own products or services.
As a California resident, The California Consumer Privacy Act (“CCPA”) affords you certain rights over your personal information. you are entitled to learn what data we collect about you, ask to delete your data and not to sell (share) it. To exercise your data protection rights, you can submit a written request to abloomy@abloomy.com.
8. Notice to European Union Data Subjects
This Section applies specifically to European Union Data Subjects in compliance with General Data Protection Regulation (“GDPR”). For the purpose of this section, terms used but not defined shall have the meaning ascribed to them in GDPR.
You have the right to request, 1, a copy of your personal information which we holds about you, 2, that we corrects any personal information if it is found to be inaccurate or out of date; 3, your personal information is erased where it is no longer necessary for us to retain such data; 4, to withdraw your consent to the processing of your personal information at any time; 5, that we provide you with your personal information and where possible, to transmit that data directly to another data controller (where applicable); 6, a restriction is placed on further processing where there is a dispute in relation to the accuracy or processing of your personal information, 7, to lodge a complaint with a European Union Data Protection or Supervisory Authority.

9. Storage and Transfer of the Information
The data that we collect from you will be processed and stored at a destination located in the United States. We transfer data to destinations outside of the European Union as a necessary part of the performance of the Services, or with your consent, as applicable.
10. Retention of the Information
We keep your personal data to enable your continued use of the Services, for as long as it is required to fulfill the relevant purposes described in this Privacy Policy, as may be required by law such as for tax and accounting purposes, or as otherwise communicated to you.
11. Changes to Privacy Policy
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Site. We may, and if required by law will, also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email (if you have an account where we have your contact information) or another manner through the Site.
Any modifications to this Privacy Policy will be effective upon our posting the new terms and/or upon implementation of the new changes on the Sites (or as otherwise indicated at the time of posting). In all cases, your continued use of the Services after the posting of any modified Privacy Policy indicates your acceptance of the terms of the modified Privacy Policy.
